Where did Hernia mesh makers go wrong?

Many of us have seen advertisements regarding lawsuits against the makers of hernia mesh. Why do these lawsuits seem to be so common?

In general, lawsuits against the makers of hernia mesh claim that the mesh wasn’t a good design (made from materials that shrink or harden or otherwise complicate a person’s health over time). In addition, some have claimed that the manufacturers pushed doctors toward using the mesh even when other simpler procedures such as stitches would have worked fine.

Some of the complications people can experience after hernia mesh is implanted in their body may include infections, bowel perforations, bowel obstructions, additional surgeries, damage to organs and chronic pain.

Depending upon the mesh and manufacturer, some coatings have been shown to cause adverse reactions, some meshes contract over time and pull tissue as they do so, and sometimes the human body simply rejects the foreign material of the mesh.

The lawsuits are generally based on claims that the manufacturers knew about some of the defects and potential issues, but failed to disclose that in their rush to market their products.

In 2011, C.R. Bard settled 3,000 cases over its Kugel Mesh for $184 million. That device had been recalled by the FDA in 2005, 2006 and 2007. In addition to Bard/Davol, there have been large hernia mesh lawsuits against:

  • Atrium
  • Covidien
  • Ethicon
  • and others
